Disturbing the peace: who can report it?


We began by saying that the crime in question can be prosecuted ex officio. What does this mean in practice? That someone doesn't need to report to end up on trial. All it takes is for a policeman to pass by and believe that the noise produced could disturb people. It doesn't even matter if it's the height of summer or a Saturday night when everyone is out having fun: it's the potential of the injury that matters.

The same applies if only one person reports it because they were woken up in the middle of the night: if the area is inhabited and therefore other people could have been disturbed, you are still condemned.
