Public peace and tranquility
The fine provided for by art. 659 penal code. pursues the aim of preserving public peace and tranquility and the related rights of people to employment and rest and the jurisprudence of legitimacy is oriented in the sense of considering the suitability of the fact to cause disturbance to an indeterminate number of people as an essential element of said crime (confirmed the existence of the crime expected that the noises and vibrations produced by the motors which served to maintain a certain temperature inside the building used by the company owned by the accused were such as to cause disturbance to the residents of the condominium located nearby of that cabin).
