Disturbing noises in condominiums: what the law says


With the entry into force of the 2013 condominium reform, annoying noises made by condominiums outside the hours established by the condominium regulations can be sanctioned by the administrator with a fine of up to 200 euros, which can even reach 800 euros in cases of repeated disruptive actions.

According to the provisions of the art. 70 of the civil code, in fact, for infringements of the condominium regulations, payment of up to 200 euros is foreseen and, in the event of a repeat offense, up to 800 euros and the sum is donated to the fund available to the administrator for ordinary expenses .

Before being actually applied, any sanction must be approved by the assembly with a relative resolution. The penal code also provides for sanctions for disturbing noises in condominiums. In fact, according to the provisions of article 659 (Disturbance to people's occupations and rest), anyone who causes a serious disturbance with annoying noises, shouts, sound instruments or anything else can be punished with a fine of up to 309 euros and arrest for up to three months.

In order, however, to arrive at these punishments provided for by the art. 659 of the Criminal Code applies, it is necessary to present actual proof of what is declared, namely that the disturbing noises were quite annoying and exceeded the limits of normal tolerability of sound emissions.
